General Terms and Conditions (GTC) \u2013 Pole Artzzz<\/strong><\/p>

1. Scope<\/strong>
These General Terms and Conditions (GTC) apply to all offers, services, and contracts of the Pole Dance Studio \u201ePole Artzzz\u201c (hereinafter referred to as the \u201eStudio\u201c) and its customers (hereinafter referred to as \u201eParticipants\u201c). \u201eCourse\u201c and \u201eClass\u201c are used synonymously. By booking a course or using the studio, participants accept these GTC.<\/p>

2. Formation of the contract<\/strong>
2.1. A contract is concluded by registering via the *bsport* booking system, purchasing a course package, or taking out a membership.
2.2. The contract is personal and may not be transferred to third parties.
2.3. Participation in training is only permitted from the age of 16. Minors require the written consent of a parent or guardian.<\/p>

3. Duration and termination of membership (= subscription)<\/strong>
3.1. Memberships have a minimum term of 4 months. After the minimum term has expired, the membership will automatically renew each month unless cancelled with due notice.
3.2. Membership cancellations must be sent via email to info@poleartzzz at least 3 weeks before the current term expires.
3.3. In the event of late payment, the studio reserves the right to terminate the contract with immediate effect and to block access to courses.
3.4 Unused classes can be carried over from one month to the next. However, upon termination of the contract, unused classes will expire at the end of the membership. Unused, carried-over classes will also expire at the latest 1 year after purchase, even if the subscription is still active.<\/p>

4. Payment Terms<\/strong>
4.1. Membership fees are due monthly in advance. Payment is made by SEPA direct debit or credit card at the beginning of each month.
4.2. In the event of late payment, \u201ePole Artzzz\u201c reserves the right to block access to courses and to pass on outstanding debts to a debt collection agency.<\/p>

5. Price Changes<\/strong>
\u201ePole Artzzz\u201c reserves the right to change prices for memberships and courses. Price changes for ongoing contracts will be announced at least 4 weeks in advance. In the event of a price increase, members have the right to terminate the contract extraordinarily.<\/p>

6. Vouchers<\/strong>
6.1. \u201ePole Artzzz\u201c offers vouchers for sale which, depending on their description, can be used for classes or memberships.
6.2. The vouchers are valid for 6 months from the date of purchase and cannot be redeemed for cash. Vouchers can be used by one person; any remaining balance is non-transferable.<\/p>

7. Course Packages and Individual Bookings<\/strong>
7.1. The purchase of course packages or individual courses is binding and cannot be cancelled or reversed.
7.2. A refund of course fees already paid is excluded, unless the studio cancels the course due to insufficient participant numbers. In this case, credit will be issued to the participant's Bsport customer account, which can be offset against future bookings.
7.3 Course packages and individual bookings are valid for a specified period, depending on the type, and extensions are not possible.<\/p>

8. Course Changes<\/strong>
8.1 The studio reserves the right to change the course programme or the trainers if necessary. Such changes do not entitle participants to terminate their contract or receive a refund.
8.2 The studio reserves the right to cancel or postpone courses if a minimum number of participants is not reached. In this case, fees already paid will either be refunded or credited towards a future course.<\/p>

9. Cancellation, Withdrawal and Lateness<\/strong>
9.1. Booked courses may be cancelled free of charge up to 24 hours before the course begins. Cancellations made later than this or no-shows will incur the full course fee.
9.2. In the event of course cancellations by the studio, any fees already paid will either be refunded or credited towards future courses.
9.3 Punctuality for courses is mandatory. Should participants arrive more than 5 minutes late after the course has started, Pole Artzzz reserves the right to refuse participation in the course without any refund or credit of the course fee.<\/p>

10. Right of withdrawal for online contracts<\/strong>
10.1. For contracts concluded online, there is a 14-day right of withdrawal. The withdrawal must be made in writing.
10.2. However, if a course has already been booked and used within the cancellation period, the right of cancellation shall expire.<\/p>

11. Exclusion of Liability and Compensation for Property Damage<\/strong>
11.1. Participation in the courses is at your own risk. \u201ePole Artzzz\u201c is only liable for damages caused by gross negligence or wilful intent.
11.2. The studio accepts no liability for personal belongings or valuables brought in.
11.3 The participant shall be liable for any damage caused by them to the studio's facilities or equipment. The damage must be fully compensated.<\/p>

12. Membership Pause<\/strong>
In the event of a prolonged illness (> 14 days) or pregnancy, membership may be put on hold upon presentation of a doctor\u2019s certificate. However, there is no entitlement to a suspension.<\/p>

13. Health and Safety<\/strong>
13.1. Participants are required to inform the studio or the trainers of any health restrictions, injuries or illnesses before the class begins.
13.2. Pregnant women are strongly advised against participating in the courses. Should training nonetheless be undertaken, this is at your own risk.<\/p>

14. Use of Studio Facilities<\/strong>
14.1. Use of the studio facilities is at your own risk. Participants are responsible for their own physical health and fitness.
14.2. Instructors\u2019 and studio staff\u2019s instructions must always be followed.
14.3. Bringing your own training equipment or aids is only permitted after consultation with the studio.<\/p>

15. Behaviour in the Studio<\/strong>
15.1. Respectful behaviour towards other participants and staff is mandatory. Discrimination, harassment or violence will not be tolerated and will result in immediate exclusion from the studio without refund entitlement.
15.2. Participants are obliged to treat the studio's facilities with care and ensure cleanliness and tidiness.<\/p>

16. Community Events
<\/strong>16.1. The provision of premises by Pole Artzzz for community events is on a voluntary basis and without any obligation to the organiser.
16.2. We We reserve the right to cancel or postpone the event at short notice should it not align with our values or if other issues arise for which no solution can be found. We will not cover any costs that may be incurred by the organiser as a result.
16.3 The decision regarding the execution of the event rests solely with Pole Artzzz at all times.
16.4 Pole Artzzz shall bear no costs incurred in connection with the event.<\/span><\/p>

Data Protection<\/strong>
17.1. \u201ePole Artzzz\u201c collects and stores participants' personal data for the purpose of contract processing and customer support in accordance with the provisions of the General Data Protection Regulation (GDPR).
17.2. The data will be treated confidentially and not passed on to third parties, unless there is a legal obligation.<\/p>

18. Changes to the T&Cs<\/strong>
\u201ePole Artzzz reserves the right to change these Terms and Conditions at any time. Changes will be announced in good time and are deemed accepted if they are not objected to in writing within two weeks.<\/p>

19. Final Provisions<\/strong>
19.1. Should a provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
19.2. The law of the Federal Republic of Germany shall apply. The place of jurisdiction shall be Berlin, insofar as this is legally permissible.<\/p>
